New Concealed Carry Law in NY State is on Life Support.
This unconstitutional law went into effect on September first, but its days are numbered, and Kathy Hochul knows it!
Although Kathy Hochul’s new, unconstitutional, concealed carry law has gone into effect on September 1st, it did not stop a federal judge from writing an opinion that clearly pours a whole bunch of cold water on it!
On July 11, 2022, Gun Owners of America and one of its members, Ivan Antonyuk filed a lawsuit challenging the constitutionality of New York State’s new concealed carry law.
Even though the case was dismissed by US District Court Judge, Glenn T. Suddaby, he did so only on a technicality. Upon dismissal, Governor Kathy Hochul was very pleased and put a statement out on Twitter, that the decision is right and just. Well, apparently, she didn’t read Judge Glenn Suddaby’s 78 page opinion that clearly shows the new law is unconstitutional and therefore, a temporary inconvenience for law abiding citizens of New York State. In other words, without the technicality, this case had a very likely chance of success. Are you listening Kathy?

The challenges to this unconstitutional law are spelled out in the Judge’s decision as follows;
The new law omitted the phrase “other than self defense” which would create a 2nd Amendment issue.
The list of sensitive places is too extensive. It also usurps private property rights by placing restrictions on those properties, when it is really none of the government’s business.
The law also requires several years of social media posts for individuals applying for a CCW. This means an issuing officer can punish someone by not issuing the CCW based on what they read on their social media. This is a clear violation of the 1st Amendment.
Fifth Amendment issues arise from the applicant potentially incriminating themselves by providing all the information required when applying for the permit.

The New York State Legislature and Kathy Hochul either did not think this law through when they went into private session for 5 minutes to draw it up, or they did so in hopes that this tyrannical law would somehow weather the legal storm that is coming. In reality, this law will last about as long as a snowflake on an Arizona windshield! So be patient everyone, its days are numbered!
